Sessions III issued the transfer order, citing serious constitutional issues raised in \u00d6zt\u00fcrk\u2019s detention. These student government resolutions had drawn campus-wide attention.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Despite these accusations, Judge Sessions declined the government\u2019s motion to dismiss \u00d6zt\u00fcrk\u2019s habeas corpus petition, stating that she \u201chas raised significant constitutional concerns with her arrest and detention.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Her legal team has claimed that federal officials are attempting to manipulate the case&#8217;s location to sway the outcome in their favor.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cA university op-ed advocating for human rights and freedom for the Palestinian people should not lead to imprisonment,\u201d said her attorney Mahsa Khanbabai. \u201cOur immigration laws should not be manipulated to rip people away from their homes and their loved ones.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Friday\u2019s decision permits \u00d6zt\u00fcrk to remain in ICE custody in Vermont, where her federal court petition can continue alongside her immigration case in Louisiana. Her attorneys welcomed the decision, calling it a positive step in the battle over due process.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Department of Justice has not issued any comment on the case.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This development highlights a broader effort by the Trump administration to deport international students involved in activism related to Israel&#8217;s military actions in Gaza following the October 7, 2023, Hamas attacks.<\/span><\/p>\n<p><a href=\"https:\/\/www.tufts.edu\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Tufts University <\/span><\/a><span style=\"font-weight: 400;\">has publicly supported \u00d6zt\u00fcrk and filed for her release. information suggesting that she has acted in a manner that would constitute a violation of the University\u2019s understanding of the Immigration and Naturalization Act,&#8221; Tufts declared earlier
