{"id":4139,"date":"2025-04-15T06:30:42","date_gmt":"2025-04-15T06:30:42","guid":{"rendered":"https:\/\/prepsaret.com\/news\/?p=4139"},"modified":"2025-04-15T06:30:42","modified_gmt":"2025-04-15T06:30:42","slug":"openai-strikes-back-in-legal-clash-with-elon-musk","status":"publish","type":"post","link":"https:\/\/prepsaret.com\/news\/openai-strikes-back-in-legal-clash-with-elon-musk\/","title":{"rendered":"OpenAI Strikes Back in Legal Clash with Elon Musk"},"content":{"rendered":"<h1 style=\"text-align: center;\"><b>OpenAI Strikes Back in Legal Clash with Elon Musk<\/b><\/h1>\n<p><span style=\"font-weight: 400;\">OpenAI has filed a counterclaim against Elon Musk, accusing him of waging an ongoing campaign to damage the organization\u2019s reputation and operations.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The filing urges a federal judge to step in and block Musk from engaging in what OpenAI describes as \u201cunlawful and unfair action\u201d against the AI company he helped launch.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The dispute centers on OpenAI\u2019s strategic direction and its transition to a capped-profit model, a shift the company considers crucial for securing a $40 billion funding round by the end of the year.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Musk, who left the company years before its rise to prominence, has since established his own AI firm, xAI, and become an outspoken critic of OpenAI\u2019s current path.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In a legal response filed in California\u2019s Northern District, <\/span><a href=\"https:\/\/openai.com\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">OpenAI<\/span><\/a><span style=\"font-weight: 400;\"> alleges that Musk is deliberately undermining the company\u2019s work.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThrough press attacks, malicious campaigns broadcast to Musk\u2019s more than 200 million followers on the social media platform he controls, a pretextual demand for corporate records, harassing legal claims and a sham bid for OpenAI\u2019s assets, Musk has tried every tool available to harm OpenAI,\u201d the company stated in its filing.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">OpenAI is seeking legal protection to halt Musk\u2019s alleged interference and is calling for accountability for what it calls the \u201cdamage he has already caused.\u201d A jury trial is expected to begin next spring.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Related blog post: <\/span><a href=\"https:\/\/prepsaret.com\/comptia\/cybersecurity-news\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Cybersecurity News<\/span><\/a><\/p>\n<h2 style=\"text-align: center;\"><b>Musk&#8217;s Acquisition Offer Sparks New Tensions<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Tensions escalated earlier this year when Musk\u2019s team made a $97.4 billion offer to acquire OpenAI\u2014an offer the company ultimately rejected. Musk\u2019s attorneys argue that the board failed to properly consider the proposal.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cHad OpenAI\u2019s board genuinely considered the bid as they were obligated to do, they would have seen how serious it was,\u201d said Marc Toberoff, Musk\u2019s lawyer. \u201cIt\u2019s telling that having to pay fair market value for OpenAI\u2019s assets allegedly \u2018interferes\u2019 with their business plans.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">OpenAI countered on X, the social platform now owned by Musk, stating: \u201cElon\u2019s nonstop actions against us are just bad-faith tactics to slow down OpenAI and seize control of the leading AI innovations for his personal benefit.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Meanwhile,<\/span><a href=\"https:\/\/x.ai\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\"> xAI<\/span><\/a><span style=\"font-weight: 400;\">, Musk\u2019s AI company, recently completed a $33 billion deal to acquire X, expanding its footprint in the digital and AI sectors. Musk, who also heads Tesla, originally filed a lawsuit against OpenAI last year, accusing it of abandoning its original mission.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">OpenAI
